By accessing and using the services provided by pedigrfgvs B.V. ("Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our website, adventure travel services, and any related services provided by pedigrfgvs.

If you do not agree to abide by the above, please do not use our services. Your continued use of our services following the posting of changes to these terms will mean you accept those changes.

Service Description

pedigrfgvs provides adventure travel services including but not limited to mountain adventures, wilderness expeditions, coastal adventures, and related travel arrangements. Our services include trip planning, guide services, equipment provision, and coordination of adventure activities.

All services are subject to availability and may be modified or cancelled due to weather conditions, safety concerns, or other circumstances beyond our control.

Booking and Payment Terms

Booking Process

• All bookings must be made through authorised channels
• Bookings are subject to availability and confirmation
• A deposit may be required to secure your booking
• Full payment is typically required 30 days before departure

Payment Terms

• All prices are quoted in EUR unless otherwise specified
• Prices include VAT where applicable
• Payment can be made via accepted methods as specified during booking
• Late payment may result in booking cancellation

Cancellation Policy

• Cancellations must be made in writing
• Cancellation fees apply according to our cancellation schedule
• We recommend comprehensive travel insurance
• Force majeure events may affect cancellation terms

User Obligations and Responsibilities

Participant Requirements

As a participant in our adventure travel services, you agree to:

• Provide accurate and complete information about your fitness level and medical conditions
• Follow all safety instructions and guidelines provided by our guides
• Behave in a responsible manner that does not endanger yourself or others
• Respect local customs, laws, and environmental regulations
• Arrive with appropriate fitness levels for your chosen adventure
• Carry adequate travel and health insurance

Prohibited Conduct

You agree not to:

• Engage in any illegal activities during our services
• Use our services under the influence of alcohol or drugs
• Damage equipment or property
• Harass or intimidate other participants or staff
• Ignore safety instructions or venture into restricted areas
• Use our services for any commercial purpose without permission

Safety and Risk Acknowledgement

Adventure travel involves inherent risks. By participating in our services, you acknowledge that outdoor activities carry risks of injury, illness, or death. You participate voluntarily and at your own risk.

We maintain high safety standards and provide qualified guides, but we cannot eliminate all risks associated with adventure activities. You are responsible for ensuring you are physically and mentally prepared for your chosen adventure.

We reserve the right to refuse service or remove participants who pose a safety risk to themselves or others.

Intellectual Property

All content on our website and in our materials, including text, graphics, logos, images, and software, is the property of pedigrfgvs or its content suppliers and is protected by international copyright laws.

You may not reproduce, distribute, display, or create derivative works from our content without express written permission. The pedigrfgvs name and logo are trademarks of pedigrfgvs B.V.

You grant us a non-exclusive, royalty-free license to use any photos, videos, or testimonials you provide in connection with our services for marketing and promotional purposes.

Limitation of Liability

To the maximum extent permitted by law, pedigrfgvs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount paid by you to pedigrfgvs for the specific service giving rise to the liability.

We are not responsible for delays, cancellations, or modifications due to weather conditions, natural disasters, political situations, or other circumstances beyond our reasonable control.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Force Majeure

pedigrfgvs shall not be held responsible for any failure or delay in performance under these terms which is due to fire, casualty, flood, earthquake, other natural disasters, war, terrorism, labour disputes, government actions, or other causes beyond our reasonable control. In such cases, we will work with you to reschedule or provide alternative arrangements where possible.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to our Privacy Policy and the processing of your personal data as described therein.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands. You and pedigrfgvs agree to submit to the personal jurisdiction of such courts.

Dispute Resolution

We encourage resolution of disputes through direct communication. If you have a complaint or dispute, please contact us first to attempt to resolve the matter informally.

If informal resolution is not possible, disputes may be resolved through mediation or arbitration as permitted by Dutch law, before resorting to litigation.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service.

Upon termination, your right to use our services will cease immediately. All provisions of the Terms of Service which by their nature should survive termination shall survive termination.

You may terminate your relationship with us at any time by discontinuing use of our services, subject to any applicable cancellation terms and fees.

Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

Your continued use of our services after we post any modifications to the Terms of Service on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Terms of Service.

Severability

If any provision of these Terms of Service is held to be invalid or unenforceable by a court, the remaining provisions of these Terms of Service will remain in effect. These Terms of Service constitute the entire agreement between us regarding our service.
